1. General provisions
1.1. These purchase and sale terms (the Terms) set out the conditions for buying goods on the MotoDome website and/or online shop, the rights and obligations of the Buyer and the Seller, payment, order fulfilment, delivery and other matters related to the purchase of goods.
1.2. Seller:
MB „Piritas“
Company code: 304067896
VAT code: LT100010941416
Address: Rodūnios kelias 11, LT-02189 Vilnius, Lithuania
Email: sales@moto-dome.com
Phone: +370 612 99225
1.3. These Terms apply to purchases of MotoDome, DockIT and other goods offered on the Seller’s website, unless different individual conditions have been expressly agreed for a specific order.
1.4. By placing an order, the Buyer confirms that they have read these Terms, the Privacy Policy, the Return and Refund Policy and, where applicable, the Warranty Terms.
1.5. Consumers enjoy the consumer rights provided by the laws of the Republic of Lithuania and the European Union. Nothing in these Terms may be interpreted as limiting the mandatory rights granted to consumers.
2. Buyer
2.1. Goods may be purchased by:
- natural persons with full legal capacity;
- legal entities;
- authorised persons lawfully acting on their behalf.
2.2. If the Buyer is a natural person purchasing goods for purposes unrelated to their business, trade, craft or profession, they are considered a consumer and the relevant consumer protection rights apply.
2.3. Rights intended for consumers, including the statutory 14-day right of withdrawal from a distance contract, do not apply to legal entities or to natural persons purchasing goods for the purposes of their business, trade, craft or profession, unless the law provides otherwise in a specific case.
3. Goods and product information
3.1. The main characteristics of MotoDome, DockIT and other goods offered are set out on the respective product pages.
3.2. The Seller aims to ensure that product descriptions, technical specifications, dimensions, configurations, photographs and other information on the website are accurate and up to date.
3.3. The colours and visual appearance of goods on screen may differ slightly from the actual product due to the Buyer’s device, screen settings, lighting and other objective circumstances.
3.4. If the Buyer chooses an individual colour, configuration, technical solution or other individual modification of the product, such choices are confirmed before the order is fulfilled.
4. Prices
4.1. Prices on the website are stated in euros (EUR).
4.2. Prices shown to consumers include the applicable value added tax (VAT), unless a specific offer clearly states otherwise.
4.3. Delivery costs are included in the price of a product only if this is clearly stated for the specific product or offer.
4.4. Where, due to the nature of the product, the country of delivery, the address, access conditions, the transport required or other circumstances, the delivery price cannot reasonably be calculated in advance, it is calculated individually and provided to the Buyer before the purchase and sale contract is concluded and the final payment is made.
4.5. The Buyer is not charged any additional costs that they were not properly informed about before the contract was concluded.
5. Placing an order and concluding the contract
5.1. DockIT order
The Buyer selects DockIT and, if the product is sold directly in the online shop, places an order by providing the information required for the order and choosing from the available delivery and payment methods.
Before placing a paid order, the Buyer can review and, if necessary, correct the information provided.
The order becomes binding on the Buyer only once they have expressly confirmed that placing it creates an obligation to pay.
5.2. MotoDome order
Because of the nature, size and weight of MotoDome, the chosen configuration and the individually calculated delivery, a MotoDome enquiry submitted on the website is not in itself a final purchase and sale contract, unless the ordering process clearly states otherwise.
After receiving the Buyer’s enquiry, the Seller may contact the Buyer about the chosen MotoDome model, configuration, delivery address, access conditions and other information needed to fulfil the order.
Having assessed the information provided, the Seller sends the Buyer a final offer stating:
- the price of the chosen MotoDome model and additional equipment;
- the applicable VAT;
- the delivery price;
- the estimated production / preparation time;
- the estimated delivery time;
- other information relevant to the specific order.
5.3. The purchase and sale contract is deemed concluded when the Buyer accepts the Seller’s final offer and/or makes the payment stated in the offer, depending on the ordering process of the specific order.
5.4. Confirmation of the concluded distance contract and the information that applies to it is provided to the Buyer on a durable medium, for example by email.
6. Payment
6.1. Goods can be paid for using the payment methods stated on the website and/or in the individual offer.
6.2. The specific payment methods available are shown to the Buyer before the order is confirmed.
6.3. A MotoDome order requires a 50% advance payment against a proforma invoice, with the remaining amount paid before delivery. This information, or another individual payment schedule, its amount, deadlines and conditions, is stated in the offer provided to the Buyer.
6.4. Production of the product or fulfilment of the order may begin only after the agreed payment or advance has been received, unless the specific offer provides otherwise.
7. MotoDome production and order preparation
7.1. Preparing and assembling a MotoDome motorcycle garage usually takes about 4–6 weeks, unless a different time is stated in the specific offer.
7.2. Individual colours, non-standard configurations or other individual solutions may affect the production time.
7.3. The specific estimated preparation and delivery time of the order is confirmed to the Buyer when the order is placed.
7.4. If the order fulfilment time changes due to circumstances reasonably beyond the Seller’s control, the Buyer is informed as soon as possible.
8. DockIT order preparation
8.1. If DockIT is in stock, the order is prepared for dispatch within the time stated for the product or at the time of ordering.
8.2. The actual delivery time depends on the Buyer’s country, region, delivery address and the chosen method of transport.
8.3. If DockIT is not in stock at the time of ordering, the Buyer is informed of the estimated preparation and delivery time.
9. Delivery
9.1. Goods are delivered to the address agreed at the time of ordering or in the individual offer.
9.2. The delivery price depends on the product, the country of delivery, the address, the method of transport and other circumstances relevant to the specific delivery.
MotoDome delivery
9.3. MotoDome is delivered fully assembled.
9.4. As MotoDome weighs approximately 580 kg, specialised transport and a loader crane may be required to transport, unload and position it.
9.5. Before delivery, the Buyer must ensure that the delivery site is properly prepared and accessible to the delivery and unloading equipment according to the conditions agreed in advance.
9.6. MotoDome requires a firm and as level as possible base, for example a concrete, paved or asphalt surface. The position of the structure can be adjusted with adjustable supports according to the product’s technical specifications.
DockIT delivery
9.7. DockIT is delivered partly disassembled and must be assembled and properly fixed to a suitable base according to the installation instructions provided.
10. Handover of goods and transport risk
10.1. On receiving the goods, the Buyer should check the condition of the shipment and, as far as reasonably possible, of the product.
10.2. If obvious transport damage is noticed, it is recommended to record it in the delivery documents and in photographs and to inform the Seller as soon as possible.
10.3. Failure to do so does not in itself deprive the consumer of the mandatory rights provided by law.
10.4. Where the Seller organises the transport, the risk of damage to or loss of the goods essentially remains with the Seller until the goods are handed over to the consumer, except in cases provided by law.
11. Right of withdrawal and returns
11.1. A consumer buying goods at a distance has, in the cases provided by law, a 14-day right to withdraw from the contract without giving any reason.
11.2. Detailed conditions for withdrawal from the contract, returns of MotoDome and DockIT, transport costs and refunds are set out in the separate Return and Refund Policy, which forms part of these Terms.
11.3. If the consumer exercises the right of withdrawal and returns goods of proper quality, the direct cost of transporting the goods back to the Seller is paid by the Buyer, provided they were properly informed of this obligation before the contract was concluded.
11.4. The Seller refunds the cost of the original standard delivery to the Buyer as provided by law. If the Buyer chose a more expensive delivery method than the cheapest standard delivery offered by the Seller, the Seller is not obliged to refund the additional difference in price.
12. Made-to-order and personalised goods
12.1. The right of withdrawal from a distance contract may not apply to goods made to the Buyer’s individual specifications or clearly personalised to their needs, where an exception provided by law applies to the specific order.
12.2. If a specific individual MotoDome or DockIT order falls under this exception, the Buyer is clearly informed of this before the contract is concluded and payment is made.
12.3. The mere fact that a product is manufactured or ordered only after the Buyer’s order has been received does not in itself mean that the right of withdrawal automatically does not apply to it.
13. Product quality and warranty
13.1. Consumers have the rights provided by law regarding the conformity of goods and the statutory guarantee.
An EU consumer is granted a statutory guarantee of at least 2 years from receipt of the goods, and national law may provide additional protection in certain cases.
13.2. If the goods are defective or do not conform to the contract, the consumer is entitled to the remedies provided by law.
13.3. In addition, a commercial warranty may be provided for certain MotoDome and DockIT components.
13.4. Commercial warranties
MotoDome:
- 20-year commercial warranty on the MotoDome body;
- 2-year commercial warranty on electrical parts and components.
DockIT:
- 36-month commercial warranty on the entire body and moving parts, except for mechanical paint damage and corrosion resulting from it.
13.5. The detailed terms of the commercial warranty, its scope, exclusions and the warranty service procedure are set out in the separate Warranty Terms.
13.6. The commercial warranty does not replace or limit the consumer’s statutory rights.
14. Complaints and customer service
14.1. If you have any questions about an order, delivery, product quality or other matters related to your purchase, contact us:
By email: sales@moto-dome.com
By phone: +370 612 99225
14.2. When contacting us about a specific order, it is recommended to state the order or invoice number, the product name and a description of the problem and, where relevant, to attach photographs or other information supporting the situation.
14.3. The Seller handles consumer requests and complaints in the manner and within the time limits set by law.
15. Liability
15.1. The Seller is liable for fulfilling its obligations under the concluded purchase and sale contract to the extent provided by law.
15.2. The Buyer is responsible for the correctness and accuracy of the information provided when ordering.
15.3. The Buyer must provide a correct delivery address, contact details and other information needed to fulfil the order and the delivery.
15.4. In the case of MotoDome, the Buyer must also provide correct information about the delivery site and access conditions, where this information is needed to assess the price and feasibility of transport and unloading.
15.5. No provision of these Terms may be interpreted as excluding or limiting the Seller’s liability in cases where such liability cannot be limited under applicable law.
16. Personal data protection
16.1. The Buyer’s personal data is processed for accepting and fulfilling orders, delivery, payment administration, customer service, compliance with legal obligations and other legitimate purposes.
16.2. Detailed information about the processing of personal data is provided in the Privacy Policy.
17. Changes to the Terms
17.1. The Seller has the right to change these Terms to reflect changes in legislation, business processes, products, delivery or other circumstances.
17.2. A specific order is governed by the version of the Terms in force when the contract was concluded, unless the law provides otherwise.
17.3. Changes to the Terms do not apply retroactively in a way that would worsen the conditions of a contract already concluded, except in cases provided by law.
18. Applicable law and dispute resolution
18.1. These Terms and the contracts concluded under them are governed by the law of the Republic of Lithuania.
18.2. This choice of law does not deprive a consumer residing in another European Union member state of the protection afforded to them by the mandatory provisions of the law of their country of residence, where these apply under EU law.
18.3. If a problem arises, the Buyer is first invited to contact the Seller:
MB „Piritas“
Rodūnios kelias 11, LT-02189 Vilnius, Lithuania
sales@moto-dome.com
+370 612 99225
18.4. If a dispute with a consumer cannot be resolved directly, the consumer may apply to the competent out-of-court consumer dispute resolution body in accordance with applicable law.
19. Final provisions
19.1. These Terms, together with the information on the specific order, the final individual offer where one is provided, the Return and Refund Policy, the Warranty Terms and the Privacy Policy, make up the full set of contractual and pre-contractual conditions provided to the Buyer, to the extent they apply to the specific purchase.
19.2. Where conditions applicable to a specific order are expressly agreed in an individual offer from the Seller, such individually agreed conditions take precedence over the general Terms to the extent permitted by applicable law.
